Disclosure vs. Claim
Disclosure vs. Claim Disclosure vs. Claim Disclosure vs. ClaimInventors are often cash poor at the beginning of their efforts to commercialize a new invention and sometimes resort to preparing a patent application for themselves. However, there are traps for unwary do-it-yourselfers, one of them being too much disclosure in the descriptive part of the application, called the specification. This trap is known to catch even somewhat knowledgeable professionals. There are three kinds of patents, but the one most commonly sought is the utility patent. (The others are the design patent, which covers the appearance but not the works of an object, and a plant patent, for new varieties of growing things.) A utility patent application has different partstypically, a specification, claims, and a drawing. These sections help to meet legal requirements for an accurate description of the invention. According to the Supreme Court in an 1878 decision, an accurate description in a patent application i s required for three main reasons The government needs to know what is granted, and what will become public property when the term of the monopoly expires people who are licensed to use the invention need to know how to make, construct, and use the invention and other inventors need to know what part of the field of invention is protected and what part is not.One must be careful, though, in disclosing information.A patent serves to protect that which is claimed, not necessarily that which is disclosed in the description of the invention. Information disclosed, but not claimed, may have no patent protection at all. While it is generally true that it is important to be thorough in describing an invention in the specification, being thorough can be a trap because disclosure must also be linked to the claims. If it isnt linked, it may be best to leave it out, unless you want to give it away.A disclosure that is not also claimed is dedicated to the public and may be used freely without co ncern for infringing a patent.A case in point is PSC Computer v. Foxconn, decided by the U.S. Court of Appeals in Washington, D.C., in 2004. It involved Patent No. 6,061,239, issued on May 9, 2000. PSC owned the invention, which was for an improved means of attaching a heat sink to a computer circuit board. When Foxconn introduced a clip made of plastic, PSC sued, alleging that the design infringed the patent. The specific language in the written description in the patent stated, The elongated strap is made of a resilient metal such as stainless steel although other resilient materials may be suitable for the strap. The patent specification also noted, Other prior art devices use molded plastic and/or metal parts that must be cast or forged which again are more expensive metal forming operations. One might logically conclude, since the specification noted that the strap is stainless steel but that other materials can be used, that the patent covers any strap material. One would be wro ng in this case since the claim covering this element of the invention only mentions a metal strap. The patent claims a heat sink retainer clip that includes an elongated, resilient metal strap. There is no mention of a plastic strap in the claims. The court explained why a plastic strap is not protected under the patent One important purpose of the written description is to provide notice to the public as to the subject matter of the patent, while the claim provides notice as to the scope of the invention. The 239 patents claim language placed the public on notice that metal clip parts would infringe. Its written description served notice that plastic had been used as an alternative to metal in the prior art, and that the future use of plastic would therefore not infringe. The law is clear that the written description in a patent helps the public understand what is being protected by the claims by explaining which portions of the relevant art the patent does not cover. In the 1985 dec ision of SRI International v. Matsushita Electric Corp., the courts expression was even pithier Specifications teach. Claims claim.A disclosure that is not also claimed is dedicated to the public and may be used freely without concern for infringing a patent.

Do this to not miss out on life
Do this to not miss out on lifeDo this to not miss out on lifeI took a trip recently to Carmel, California. Its a quaint coastal town of art galleries, restaurants, shops, and scenic beauty. My family used to live just north of Carmel, and we vacationed there often.I stayed in a local establishment and visited countless galleries, chatting with owners and artists. The purpose of my trip was to indulge in some alone time to paint, write and think.Follow Ladders on FlipboardFollow Ladders magazines on Flipboard covering Happiness, Productivity, Job Satisfaction, Neuroscience, and moraWe often overlook the power of alone time. Most of our lives are filled with family obligations, work, appointments, and online activity. When we finally take a vacation, all the planning, travel and logistics can leave us exhausted. We end up missing a lot.The golden moments in the stream of life rush past us, and we see nothing but sand the angels come visit us and we only know them when they are gone.?- George Eliot (Mary AnnEvans)Traveling on vacation with a partner or family has its rewards, but also a few drawbacks. You make concessions on where to go, what to eat, and what to do.Its different when youre by yourself. You have total freedom to do whatever you like and to be alone with your thoughts. The trick is to actually slow down and embrace the solitude. They werent having muchfunI was enjoying a latte and shortbread cookie in a Carmel bakery, alone with my thoughts, when a French couple energetically strolled in.They approached the counter and ordered a menu item from the kitchen. It was early evening and the proprietor told them the kitchen had closed. They could purchase coffee drinks or pastries, but nothing on the kitchen menu. The French couple was visibly upset. They gestured at the menu sign and began speaking rapidly in French. The bakery owner said, Im sorry, is there something in the display case you might like? but the couple spun around and headed for the exit.I dont speak French, but when I left the bakery I saw the couple on the street corner, arguing. The man pointed one way, and the woman pointed the other way. I presumed they were debating where to eat.Illustrations by John P. WeissThe argument went on for a bit, and then in exasperation, the woman held up both her arms in some kind of surrender and followed the man as he stomped off. They werent having much fun.Little demons in theluggageWeve all been here, havent we? On a trip with our significant other. Perhaps an overdue vacation to get away, relax and recharge our engines. But then the plane is delayed, the oysters you ate didnt agree with you, and jet lag makes you both cranky. You argue about which show to see. He wants to sight-see and you want to shop. You get lost on that coastal drive and he left the sunscreen back in the hotel room. She did all the planning and is mad because he wants to hang at the bar. Before long, youre bickering. The little resentments that exist in all r elationships are supposed to stay behind when we vacation, but sometimes they tag along, like little demons in the luggage. Its best to work out who is doing what before the vacation, and agree to compromise with one another. Give one another space to do what you want. Most importantly, whether traveling with your significant other or alone, theres one thing you can do that will prevent you from missing out on lifeLet go ofcontrol.Release thestressIts weird and counterintuitive, but things seem to go mora smoothly when you give up control. When you let things happen naturally instead of trying to make things happen. You must learn to let go. Release the stress. You were never in control anyway.?- ?SteveMaraboliWhen I first arrived in Carmel for my brief, personal get-a-way, I felt strangely alone. A bit adrift.Im used to traveling with my wife and enjoying her company. While I looked forward to hours of gallery hopping, I found meals by myself were less enjoyable. I avoided expensive, fine restaurants. They seem less appealing when youre alone.Toward the end of the first day, I decided tolet goof all control and expectations and just immerse myself in the experience. When I did this, I started to relax more.I took my time in coffee shops, observing people and writing thoughts in my Moleskine notebook. I enjoyed long conversations with gallery owners and artists. I found myself reminiscing about the past, and family trips to Carmel when I was a boy.If you try to control every aspect of your life, youll miss out on a lot. Peace and serendipity seem to find you more when you let go and settle into themoments.A more peaceful state ofmindMy mini-vacation was a helpful break. While I missed my wife, son and dogs back home, the time alone allowed me to think and reflect. Time seemed to slow down. At night in my hotel room, I read for hours and filled pages in my notebook. On the last day, I left Carmel in my rental car to drive back to the airport in San Jose. I left ear ly and found I had a few hours to kill.Having let go of any itinerary, I found myself driving through my childhood town of Los Gatos, and onward to the town of Saratoga. Without much thought, I drove to La Madronia cemetery, where my Dad and maternal grandparents are buried. It was a beautiful day, as I listened to the birds and felt the breeze blowing through the trees. Heres a short video capturing the moment in the cemetery.Had I carefully planned out my Carmel trip, I doubt I would have thought to visit the cemetery where my Dad is laid to rest. Im so glad I let go of control and allowed my short, personal vacation to meander and find its own way.Letting go helps us to live in a more peaceful state of mind and helps restore our balance. It allows others to be responsible for themselves and for us to take our hands off situations that do not belong to us. This frees us from unnecessary stress. -MelodyBeattieIf you keep trying to control everything in your life, if you dont learn h ow to let go and trust in the moments, then you might miss out on the magic of life.If youre on vacation and you take a wrong turn, why not see where the unexpected road leads? If your spouse orders the wrong meal, dont get mad. Go out on a limb and try the dish. You might discover something delicious.Explore moments as theyoccurObviously, we cant abandon all our responsibilities in life and just see what happens. But not everything requires control. Vacations (and life in general) can be more fun when we let go and open ourselves up to new experiences.Carving out personal time to slow down, stop planning and just explore moments as they occur, can calm our minds and allow new ideas and thoughts to percolate. For example, one Sunday afternoon I let go of my compulsion to plan and be productive. I started experimenting in my art studio, trying new techniques with my landscape painting. The result was the paintingReflections(featured at the top of this article) which sold a few weeks a fter I painted it.Give it a try. Stop trying to control everything and just let go once in a while. Its incredibly freeing, you might discover new things, and a little bit of magic just might come into your life. Before yougoImJohn P. Weiss.I paint, draw cartoons and write about life. There#8217;s a Belief Gap about the Wage Gap, Part 3
There8217s a Belief Gap about the Wage Gap, Part 3 Last week, we posted the first two parts of this series, titled Theres a Belief Gap about the Wage Gap. In Part 1, we took a look at common misconceptions like different fields of study, motherhood as a cause and educational differences. In Part 2, we examined cultural confusions like negotiation tactics and the so-called danger premium. We also referenced studies that controlled for all of the above factors to bring the a little wage gemeinsame agrarpolitik closer to reality than the 77 cents to a dollar argument that causes so much dissension. Now, here in Part 3, its time to take a look at whats going RIGHT in the journey to wage equality. For starters, more recent studies like the GOA have begun controlling for various issues so that data stands up to vigorous scrutiny. This is important in not only how the issue is dealt with at the government al level, but also in how the media handles this issue. And while many senators voted down basic revisions to the 1964 Equal Pay Act because they felt the 2009 Lily Ledbetter Act offered sufficient protection, educated journalists and analysts are highly focused on ensuring that erroneous claims like that are proven false. In fact, Forbes Writer Bryce Covert states that lawsuits have decreased since the Act was passed and courts have become increasingly hostile toward pay discrimination casesthe number of pay discrimination complaints filed with the Equal Employment Opportunity Commission actually fell after the Lilly Ledbetter Act was signed, dropping from 2,268 to 2,191 last year. Even under current laws, women have found themselves with decreasing legal erleichterung when they file a complaint. As Irin Carmon reported, recent analysis found that courts have become more hostile over the past decade not more accommodating or sympathetic, as the Republicans seem to fear to equal p ay claims. The authors found that from 2000 to 2009, those who filed claims were only successful 35 percent of the time, compared to a 55 percent success rate from 1990 to 1999. They also found that, as Carmon explains, courts have generally been reluctant to intervene in a companys decision to pay someone less, operating on the assumption that the market is working.A keen eye on the actual facts surrounding gender discrimination and current studies, only serve to bolster the case for equal pay and run parallel to the whining feminist dismissals of late.We can look to other countries to gauge our own progress. While the UK still struggles with pay disparity between men and women (current research set the average gap between 14.9-17%), they are making strides forward. By watching their journey from equal rights to equal pay, we are able to see avenues that may be of use in identifying our strategic path forwardThe gender pay gap is complex and its causes are multi-faceted. Extending the right to request flexible working to all employees and reforming the parental leave system have the potential to make a huge difference to employer practices and womens opportunities in the workplace requiring businesses that employ more than 250 people monitor and publicise their pay gap is also key. There is one area in which women are making more money at the top Although women make up only 4% of F500 CEOs, they make more than their male counterparts (when using median pay versus average pay). While there is still much to be done for women who are perched on other rungs on the corporate ladder, top executive pay graphs show a bright spot in the otherwise bleak landscape of wage chasmsMedian compensation is a more accurate indicator of the pay of a typical CEO than average compensation because extreme outliers can skew averages and create misleading results. The average compensation for CEO men, $12.9 million, exceeded the average compensation for CEO women, $11.7 million. Howe ver, this does not indicate that a typical male CEO earned more than a typical female. Two extreme male outliers, whose earnings were each more than ten times the median earnings, brought up the average compensation for men by over a million dollars. While research regarding how colleagues perceive women is indeed discouraging, we may be at a turning point. Men are starting to talk like us in order to get more accomplished at workTraditionally, in the business world, the male model of authority was considered oben liegend to the female model of collaboration. However, its becoming abundantly clear that effective communicators are fluent with both styles. The key to success lies not only in recognizing and understanding the difference between the two styles of communication, but focusing on and creating for ones self a style that encompasses the best of both worlds. Of course, these are small victories. The most impactful is perhaps the fact that women are opting out of a system in wh ich they arent represented properly and created their own micro-economyWomen have been starting businesses at a higher rate than men for the last 20 years and tend to create home-based micro (less than 5 employees) and small businesses. Women will create over half of the 9.72 million new small business jobs expected to be created by 2018 and more and more are doing this from home offices across the country. Its a surprising statistic, especially considering that women-owned businesses only created 16 percent of total U.S. jobs that existed in 2010.But a Kellogg School of Management study may have found that even that doesnt work in womens favor. Because of our so-called American Choice Factor many women believe that leaving the workforce is a personal choice, thus perpetuating the myth that the corporate world is a level playing fieldChoice has short-term personal benefits on well-being, but perhaps long-term detriments for womens advancement in the workplace collectively. In genera l, as a society we need to raise awareness and increase attention for the gender barriers that still exist. By taking these barriers into account, the discussion about womens workplace departure could be reframed to recognize that many women do not freely choose to leave the workplace, but instead are pushed out by persistent workplace barriers such as limited workplace flexibility, unaffordable childcare, and negative stereotypes about working mothers.

High Year of Tenure In The US Military
High Year of Tenure In The US MilitaryHigh Year of Tenure In The US MilitaryIn the military, throughout the career of a soldier, airman, Marine, or sailor, members are expected to advance in rank and pay grade every few years. An enlisted person must be promoted within certain time frames during their career, or they must separate from the service. This is known as the High Year of Tenure (HYT). The Army High Year of Tenure program is calledthe zurckhalten control point As long as you are not neglecting your duties and have not been in serious trouble, an enlisted person with more than six years of service and less than 20 years of service (retirement eligible) who is involuntarily separated (under honorable conditions) is entitled to receive involuntary separation pay (severance pay). In short (for example), if an Air Force E-4 does not get promoted to E-5 by the time he/she has 8 years of military service, the member will be forced to separate. These rules are strictly enforced espec ially during times of downsizing and force reduction. A member seeking to submit a waiver should do so within 10 months of his/her HYT date and have a justifiable reason why that person should be kept in the military. This diet is easier (and cheaper) than the Mediterranean diet
This diet is easier (and cheaper) than the Mediterranean dietThis diet is easier (and cheaper) than the Mediterranean dietThe Mediterranean Diet has enjoyed quite the banner year. The most recent development might have occurred during a presentation at the American Psychiatric Associations 2019 annual meeting just this May. There, researchers motioned that adherence to the fruit and legumes rich diet can protect against the development of symptoms of depression in old age. Each unit intake increase of the most popular element of the diet, (vegetables) was associated with a 20% lower increase of instances of the mental illness. Researchers at Washington University seconded this finding, adding, that the omega three fatty acids featured in the Mediterranean diet, have been shown to yield concrete reductions to depressive moods. According to the authors, individuals that adhere to the diet are 33% less likely to develop depression.Follow Ladders on FlipboardFollow Ladders magazines on Fl ipboard covering Happiness, Productivity, Job Satisfaction, Neuroscience, and moraMichelle Qaqundah recently wrote up a paper that got published in the Natural Journal of Medicine, positing that the Mediterranean diet can lower your risk of cardiovascular disease, neurodegenerative diseases, diabetes, and even cancer. The study found a 17% and 12% decreased cancer mortality in men and women following the Mediterranean diet after five years of follow-up, Qaqundah concluded in the report.A hard act to follow no doubt, but as far as The World Health Organization is concerned, there, in fact, looms a worthy contender. The diet is in the detailsThe Nordic Diet is the brainchild of a team of scientists, nutritionists and chefs birthed back in 2004 as a method of mitigating a growing obesity trend in Norway, Denmark, Sweden, Finland, and Iceland. Although many experts have already pointed out that some of the foods featured in the diet werent actually around when the ancient Nords reigned, t he fundamental personality of the diet is based on the produce intake adopted by the Scandanavians.Already, in its young life, it has been studied to promote weight loss, without restricting calorie intake. Moreover, because the diet champions food that is locally sourced and sustainably farmed, votaries also get to pride themselves on being environmentally conscious. The rules are simple enough eat a ton of berries, vegetables, legumes, potatoes, whole grains, nuts, seeds, rye, breads, fish, seafood, low-fat dairy, herbs spices, and canola oil (more on that one in a bit). Occasionally eat free-range eggs, cheese, and yogurt, eat red meat and animal fats even less, and steerresolutely clear ofsugar-sweetened beverages, added sugars, processed meats, food additives, and refined beinahe foods. Simply put, the Nordic Diet is a critique of the excessive sugar and fat intake of the western diet, with double the fiber and seafood to boot. You might be having a hard time distinguishing betw een what I just described and the Mediterranean diet. Its true, the differences are subtle, but the World Health Organization believes the tenous contrasts deserve our consideration.Firstly, the biggest difference has to be The Nordic Diets privilege of canola and rapeseed oil, two departures from the Meddereennean diets love of olive oil. Canola and rapeseed oil are super rich in monosaturated fats which are known to promote heart health. Also, the diets origin means its contents, are primarily foods that can grow in colder climates, think kale, cabbage, brussels sprouts, etc.Save a little dough (but dont eat dough)By and large seasonal produce is more affordable than fruits that are out of season. Vegetables are the nucleus of the diet. Instead of greens being chosen to accommodate the meat, The Nordic Diet operates in reverse. A diet that sees foods like broccoli, cabbage, and berries headline main courses will by default be much cheaper than the western diet which red meat heavy , and even the Mediterranean diet which favors the typically pricier fish. It should also be noted that the Nordic Diet accepts canned fish and frozen veggie and fruits into its regimen. Seasonal produce is cheaper, canned fish is cheaper, frozen fruits are cheaper, The Nordic Diet is cheaper. For these discrepancies, however insignificant they may seem, The World Health Organization has officially endorsed the Nordic Diet as the optimal diet over the Mediterranean diet for people looking to lose weight on a budget. A bold claim, against a diet that has gained so much acclaim in recent years. However, in WHOs defense, just last year an 82-year-old woman suffering from dementia claimed to regain her memory after adhering to a diet that is eerily similar to the Nordic Diet.Sylvia Hatzner claims that after eating berries, leafy vegetables, kale, spinach broccoli, sweet potatoes, oats and abstaining from fatty and processed foods her condition drastically improved. Her, son Mark Hatnzer, would also engage in cognitive task with his mother, the both of them allowing for the occasional treat of dark chocolate. You might also enjoyNew neuroscience reveals 4 rituals that will make you happyStrangers know your social class in the first seven words you say, study finds10 lessons from Benjamin Franklins daily schedule that will double your productivityThe worst mistakes you can make in an interview, according to 12 CEOs10 habits of mentally strong people
